New Rules for OCI Registration and Cancellation

The Ministry of Home Affairs (MHA) has notified stricter regulations for Overseas Citizen of India (OCI) cards to enhance national security and legal accountability. These rules refine the grounds for registration and revocation under the Citizenship Act, 1955.

Key Change Details
Criminal Accountability OCI status can now be cancelled if a holder is sentenced to 2+ years of imprisonment or is charge-sheeted for an offence carrying a 7+ year penalty, regardless of whether the crime occurred in India or abroad.
National Interest Registration is liable for cancellation for showing disaffection toward the Constitution of India or acting against India’s sovereignty, integrity, and security.
Statutory Basis The power to cancel OCI registration is derived from Section 7D of the Citizenship Act, 1955.
OCI vs Citizenship Introduced in 2005, OCI is a “Life-long Visa.” India does not allow dual citizenship; OCI holders are foreign citizens with specific privileges.
Rights & Restrictions OCI holders enjoy parity with Non-Resident Indians (NRIs) in economic and educational fields but lack voting rights, the right to hold constitutional posts (like President or Judge), or the right to own agricultural land.
