Section 69A of the Information Technology Act, 2000

The Government has issued notice to Twitter after it reinstated several handles that mentioned a controversial hashtag on its platform.

The Government issued these orders under Section 69A of the Information Technology Act, 2000.

This is done in the interest of -

  1. sovereignty and integrity of India
  2. defence of India, security of the State
  3. friendly relations with foreign States
  4. public order (or)
  5. for preventing incitement to the commission of any cognizable offence relating to above

This is the same Section under which hundreds of Chinese apps have been banned in recent months.

The validity of the same section has been upheld by the SC in Shreya Singhal v/s. Union of India case in 2015.
